Buyer Terms of Service

1. Platform role
Birkly Marketplace is a platform where independent providers list digital extensions (plugins, themes, template packs) for Birkly CMS. For third-party offers, the provider is the seller and merchant of record. Birkly is merchant of record only for official Birkly offers. Birkly may collect a Stripe Connect application fee from third-party paid sales.
2. Accounts and purchases
You may browse the catalog without an account. Checkout requires a valid email address. Optional marketplace accounts let you view My purchases, manage entitlements, subscriptions, and fallback activation keys. Marketplace accounts are separate from Birkly CMS admin logins.
3. Entitlements and activation
Free offers install immediately and do not show a license key. Paid checkout creates an entitlement, a fallback activation key, and a signed local token for your CMS. Freemium offers create hidden entitlements with plan capabilities. No-card trials work until their trial end date. You may not share, resell, or circumvent entitlement, activation, or seat limits.
4. Seat limits and offline checks
A single-site entitlement allows one production activation plus one staging activation. Buyer self-service deactivation frees the relevant seat. Offline checks are a practical deterrent, not perfect DRM: one-time purchases may have up to 30 days of offline grace, subscriptions up to 14 days, and trials do not extend past trial end.
5. Digital goods
Extensions are delivered as downloadable artifacts verified by SHA-256 checksum at install time. You are responsible for compatible Birkly and PHP versions declared on each offer.
6. Provider relationship
Third-party providers are responsible for their listings, support, applicable seller obligations, and primary refund decisions. Paid third-party providers must use Stripe Connect and be in a Stripe-supported connected-account country during P55. Mollie, multi-PSP, and regional PSPs are out of scope for P55 Hub payments. 7. Refunds and chargebacks
Refund requests are provider-primary for third-party offers within the default 14-day window, with Birkly Ops escalation when needed. A full refund revokes the entitlement and activation slots. Chargebacks place access on hold immediately; lost disputes revoke access.
8. Acceptable use
You may not use the marketplace to distribute malware, infringe intellectual property, or violate applicable law. Birkly may suspend access or revoke entitlements for policy violations.
9. Supply chain
Listings declare trust levels and capabilities per our Marketplace policy. Install only from trusted sources and review declared capabilities before enabling plugins in production.
10. Limitation of liability
Extensions are provided “as is” to the extent permitted by law. Birkly’s liability is limited as described in the full terms once legally reviewed.
11. Changes
We may update these terms. Material changes will be posted on this page with an updated effective date.
